Chapter 7

In Chapter 7 bankruptcy, the bankruptcy trustee cancels many (or all) of your debts. At the same time it might also sell some of your property to pay your creditors. Our Brevard County attorneys will be able to tell you specifics regarding Chapter 7 bankruptcy such as, who can file, the forms you’ll need, how the process works, and what happens to your property and debts.

Chapter 11

Chapter 11 bankruptcy permits the reorganization under the bankruptcy laws of the United States. Chapter 11 bankruptcy is available to every business, whether organized as a corporation or sole proprietorship, and to individuals, although it is most prominently used by corporate entities.

Chapter 13

With Chapter 13 bankruptcy, you keep your property, but pay back all or a portion of your debts over a three to five-year period. This is unlike Chapter 7 bankruptcy, where most of your debts are cancelled but you may have to surrender some property to the bankruptcy trustee to pay your creditors.

Chapter 20

Some debtors have financial problems that are not completely solved by either a Chapter 7 or Chapter 13 bankruptcy. In certain situations, filing a Chapter 13 bankruptcy immediately after completing a Chapter 7 bankruptcy, informally referred to as “Chapter 20,” might provide more relief than filing a Chapter 7 or Chapter 13 alone.
